The Faces And Strategies Of The Deep State

We are constantly being lectured to by the media and Democrats that there is no “deep state.” That Trump and Republicans are just making up conspiracy theories to cover their own nefarious deeds.

Most people who do not imbibe only quasi-propaganda outlets such as the New York Times or CNN, understand there is a deep state, or permanent state, or some ongoing cabal of government bureaucrats that pre-date and outlast presidential administrations and have their own agenda. And they understand that agenda for three years has included getting rid of a duly elected American President.

The #resistance has included seemingly boundless denizens within the federal government. We will never know the full scale of the leakers — the primary weapon of the deep state against Trump — but we can identify dozens of people who have publicly acted, or been caught acting, in precisely a deep state sort of way.

Publicly, the resistance deep state probably starts with one of its heroes: Sally Yates.

Yates was Deputy Attorney General under Obama’s AG Loretta Lynch. When Trump was sworn into office, Lynch resigned and Yates became acting AG. When Trump signed an executive order temporarily restricting travel from a select few Middle Eastern and African countries to the United States, Yates went full resistance.

She ordered DOJ lawyers not to defend Trump’s executive order in court because she personally believed it was not consistent with the DOJ’s responsibility and questioned its lawfulness. Of course, defending it in court is what would determine its lawfulness. Yates did not hide the ball.

“For as long as I am Acting Attorney General, the Department of Justice will not present arguments in defense of the Executive Order,” she wrote. Trump fired her the same day.

Yates’ action was about more than the particular EO she didn’t like. It was a banner being waved in front of the pre-existing deep state to rally more bureaucrats to the cause. It’s important to remember that the permanent state long precedes Trump and resides on the ideological left. People throughout the George W. Bush administration decried how the State Department continuously undermined Bush policies abroad. For eight years.

In Yates’ case, she was clearly violating her oath and job description, which was to defend the executive order. If she could not, she should have resigned. She was an unelected federal hire. Not one American voted for her. But her renegade approach had the desired effect.

According to the inestimable Kimberly Strassel at the Wall Street Journal: “The Yates memo was the first official act of the internal resistance — not only a precedent but a rallying cry. Subordinates fawningly praised her in emails.”

Judicial Watch filed Freedom of Information requests and found a treasure trove of other deep staters doing that fawning through emails to Yates. One federal prosecutor called her his hero, another thanked her profusely for fighting against an unlawful president. 

Perhaps the most enlightening came from Andrew Weissmann—a career DOJ lawyer and head of the Criminal Fraud Division, who wrote: “I am so proud. And in awe. Thank you so much.” Weissmann was later hired by Robert Mueller as part of the team investigating Trump-Russia collusion. Another face of the deep state.

According to a Washington Post story a few weeks after Trump’s inauguration, 180 federal employees had signed up for a workshop to learn how to “successfully express civil disobedience.” The Post’s story revealed that bureaucrats were in “regular consultation” with Obama appointees to create strategies for opposing the administration, including work slowdowns for any policies they opposed.

The story seemed meant to paint a picture of federal employees righteously standing up against an unlawful, illegitimate and dangerous president. They were heroes like Yates, and underminers secretly following her like Weissmann. But the story actually revealed the reality of the deep state and the lengths to which it would go to stop Trump.

Another identifiable deep stater is Walter Shaub, whom Obama appointed in 2013 as head of the Office of Government Ethics, an oxymoron if there ever was one. The office is simply mandated to advise and assist the presidential administration in office and is not to be confused with being a watchdog, as the name may imply. This office was perfectly situated to actually help Trump, who never held elected office before, to avoid ethical pitfalls. That was its mandate and its purpose. That’s not what Shaub did.

The Wall Street Journal’s Strassel writes of Shaub:

“…within weeks of the election, Mr. Shaub was mimicking the president-elect from an official Twitter account: “@realDonaldTrump OGE is delighted that you’ve decided to divest your businesses. Right decision!” “@realDonaldTrump Brilliant! Divestiture is good for you, very good for America!” When Mr. Trump released his plan for his assets, Mr. Shaub blasted it at a public event with press in attendance. At one point Mr. Shaub sent one of his critical missives to hundreds of government ethics officials, every inspector general, and the chairmen and ranking members of numerous congressional committees. When administration officials began to call him out on his behavior, he loudly resigned and immediately landed a job at the liberal Campaign Legal Center.”

Of course the acts of people like James Comey, John Brennan and James Clapper are now legendary. But they are political appointees. The deep state is the permanent, unappointed and unelected bureaucrat class that also enjoys civil service protections that make firing them virtually impossible.

Deep staters have filed an enormous number of official internal complaints — perhaps as part of that civil disobedience training, or on the advice of the former Obama officials — in attempts to have the authority to define policies for their own fiefdoms, which is the sole prerogative of the executive. The Washington Post ran an infamous guest column by an Interior Department employee named Joel Clement titled: “I’m a Scientist. I’m Blowing the Whistle on the Trump Administration.”

His beef was that Trump policy was endangering some native populations in Alaska. How? Climate change. A scientist blowing the whistle! There was no merit, nor did he have standing. But, as we have seen repeatedly, it allowed eight Senate Democrats to demand an IG investigation and that, certainly, was part of the purpose, along with publicly damaging Trump.

The pattern is pretty clear in that Clement is now a senior fellow with the activist, leftist Union of Concerned Scientists.

Of course we see these patterns repeating themselves right up to the “whistleblower” on the Ukrainian phone call, but instead of IG investigations or a special counsel, we now have impeachment proceedings, or something. It’s not really clear.

Everything Trump did, from meetings, to internal memos to private phone calls with heads of state, were leaked to an eager media accurately or inaccurately. 

One study by the Senate Committee on Homeland Security and Governmental Affairs found that in just the first 18 weeks in office in 2017, the Trump administration “faced 125 leaked stories — one leak a day — containing information that is potentially damaging to national security under the standards laid out in a 2009 Executive Order signed by President Barack Obama.”

The report summarized it this way: “Under President Trump’s predecessors, leaks of national security information were relatively rare, even with America’s vibrant free press. Under President Trump, leaks are flowing at the rate of one a day.”

About 100 of the 125 dealt with Trump-Russia collusion, and the majority of those contained classified information. Which means not only were they potentially damaging to national security, they were felonies. By the time of this writing, the number of leaks must be north of 1,000 — too many for the Senate committee to even try to study. That is a lot of felonies committed by the deep state. 

Virtually all of those leakers remain unknown to the public and are likely still toiling away in the bowels of the deep state, ready to leak and otherwise undermine President Trump and the security of the nation in any possible way.

The deep state is real, and provably so. They are protected and acting in concert with each other and with Democrat lawyers and lawmakers. Re-electing President Trump is one of the greatest bulwarks against this continuing. If it works, it will become enshrined in D.C.

“Let It Play Out” Advice Regarding Mueller Investigation May Be Wrong

As far as the American people are concerned, the country seems to be in an almost no-win situation when it comes to the nation’s future. This is driven not by President Trump’s style so much as the dangerous response to his style by the liberal establishment and what is known as the “Deep State.”

The advice to not fire Special Counsel Robert Mueller, but let his investigation “play out” has long seemed the prudent path, and has been encouraged by many conservatives and Trump supporters. After all, firing Mueller is guaranteed to set off a series of events that will be politically problematic for Republicans in November and the President in 2020. And to the point of the specific Mueller investigation and the reason for appointing him, there appears to be no Russian collusion with the Trump campaign and certainly not with Trump.

However, the raid on the offices, home and hotel room of the President’s longtime personal lawyer, Michael Cohen, changes the calculus by opening up an entirely new realm of threat to the democratically elected president of the United States. Yes, the raid itself and the line it crosses that has never been crossed regarding an American president is very treacherous territory. Never has such a raid been conducted on a sitting president’s lawyer. The FBI better have rock-solid reasons for this raid — not just more of a fishing expedition based on thin evidence — or there will be hell to pay.

There may be anyway.

Because the deeper problem is that the Mueller investigation is metastasizing into an investigation of the life and times of Donald Trump and everyone ever associated with him. And that is an existential threat to democracy and the rule of law and order in this country.

Mueller did not conduct the raid or order the raid. But in the course of his very wide-ranging investigation into all things Trump, he apparently came across information regarding Trump’s attorney, Cohen, that could be criminal. Apparently, Mueller “referred” that information to prosecuting attorneys in New York, who then used it to obtain the search warrant and conduct the raid.

So this is how a fishing expedition expands, and how another level of the Deep State, for lack of a better term, can work against a president who is perceived as a threat to it. The Deep State in this case might be described as those benefitting or otherwise supporting the Washington status quo. Donald Trump most certainly does not represent the status quo way of doing business.

Mueller is someone who seems to have benefitted and supports the status quo in D.C. The range of his investigation until the Cohen raids was already well beyond the outlines set by Assistant Attorney General Rod Rosenstein’s original appointment of him. But now sharing, involving and encouraging the expanded circle of federal prosecutors around the country to target Trump associates represents a dangerously broadened scope.

Further, what those prosecutors find in their investigations can be referred to or shared with Mueller’s team. So in a sense, Mueller doesn’t just have the team of Democratic investigators and a compromised FBI at the top, he has the entire national law enforcement apparatus of the United States at his disposal to damage and bring down the President.

So “letting it play out” is looking like a recipe for investigations that will last as long as Trump remains in office. In the short-term, this is more ammunition for Democrats in 2018. In the longer term, this is aimed at Trump being politically crippled for 2020.

But in the longest term, this is a cannonball across the bow of any future President of the United States who dares to go after the beneficiaries of the Deep State status quo in Washington.

And it is all done outside the confines of the United States Constitution, which makes no allowances for an independent prosecutor answerable to no one, is unaccountable to any branch of the federal government and completely out of the reach of the American people.

And that is a threat that perhaps cannot be allowed to “play out.”

As D.C. Corruption Mounts, Here’s How The American People Can Get Justice

Unfolding events in Washington, D.C. are leaving a lot of Americans wondering where they can turn in such a deeply corrupted, self-absorbed government to get justice and protect the republic. There are actually a few options in these new and uncharted times, and at least one would be groundbreaking.

But first, here’s the corruption we now know was going on in the Obama Administration and during the presidential election:

➜ The Obama Administration clearly weaponized the most fearsome of government agencies, the Internal Revenue Service, against individual Americans and American companies who were political opponents of President Obama. The targeting of conservative and Tea Party groups by the politicized Internal Revenue Service was an explosive scandal that somehow most of the media dozed through, disinterested in pursuing. Democrats worked to obfuscate and dilute the scandal and at that point, the media woke up and helped in reporting the talking points. And all this began after a top IRS official admitting exactly what they had done. And yet, no consequences. Not one person lost their job or a penny of income.

➜ The Fast and Furious gun-running scandal to Mexican cartels was bad enough. But then Obama Attorney General Eric Holder took another step in corruption by so completely refusing to cooperate with Congress, that he was found in criminal contempt. Holder was the first member of a president’s cabinet in history to be held in contempt. Democrats of course circled the wagons and protected him while the media played it as nothing more than partisan “political theater” — helpfully using Holder’s phrase. Nothing ever happened to Holder as the White House played defense for him.

➜ There are half a dozen other major corruption scandals during the Obama years that would warrant mention but have already been meticulously covered by the conservative media. The mainstream media is happy to blather about the most scandal-free presidency in history. The point is made that during those eight years, there were several scandals for which there was never an accounting. And of course, there is no oversight (and cannot be any oversight) of the media, even a dishonestly partisan media. That’s the First Amendment.

➜ In December, Politico published a strong piece of investigative journalism that was not only astonishing in the news it broke, but was robust with sources. The story exposed how the Obama administration had secretly dumped U.S. law enforcement efforts to nail a drug-trafficking ring run by the terrorist group Hezbollah. Hezbollah is an ally of Iran and one of the reasons the country is considered a terrorist nation. Killing the American action was done to placate the Iranians to help get the awful nuclear deal in place. But the same formula applied. Democrats played defense and the remainder of the media ignored. Like, really ignored. Several days after the Politico story, neither ABC News, CBS News or NBC News had done one second on the story. Major newspapers ignored it, also. Good for Politico, but a pox on the rest of them. Of course, no consequences from this horrible betrayal of us and our ally, Israel.

➜ This brings us to the most recent breathtaking revelations of high-level FBI corruption during the 2016 presidential campaign and after President Trump’s inauguration through coordinated actions with the DNC, a British spy and Russians to deceive a FISA judge repeatedly to obtain eavesdropping warrants on members of the Trump campaign. This one continues to unfold, but even considering how bad some of the others are, this is the worst and most dangerous if it is as it looks to be. And it looks very much like leading portions of the FBI, we know some but we may not know all, were actively working with one political party and a foreign power, through a Washington opposition research firm, to influence an American election and later undermine the winner of that election.

This level of corruption is a direct assault on our democratic republic, on the freedoms enshrined in the Constitution and on the American people.

Based on the ongoing revelations in the growing dirty laundry list, and on Americans’ dwindling sense of trust in our own government, a basic question arises:

Where do the American people go to get justice?

This is actually really difficult to answer. The frontline agency that should be tasked with the investigations is the FBI, which is part of the Department of Justice within the presidential executive branch. But the FBI, or some parts of the FBI, are compromised and so entrusting the agency with an investigation that includes and centers on investigating itself, seems like a non-starter.

• The obvious possibility is appointing one or more Special Counsels to investigate the investigators. This has the inherent downside of relying on the FBI as the investigative arm, plus they are constitutionally dubious and it would be cast as just Trump politics. Still, it is a possibility.

• Another possibility is that perhaps a special task force from the federal government’s various Inspector Generals’ offices could be created and augmented by private investigators who obtain the proper security clearances. Or Congress could create a task force itself using private investigators in the same way.

Or, perhaps there is at least one more option.

• A consortium of states. This goes old-school Constitution, but originally, the idea was that the federal government would be kept in check by the various states, to whom it was beholden.

In Federalist 39, James Madison wrote regarding the approving the Constitution:

“It is to be the assent and ratification of the several States, derived from the supreme authority in each State, the authority of the people themselves. The act therefore establishing the Constitution, will not be a national but a federal act.”

This view, representative of the founders, was that the states had the authority and responsibility to check the federal government. Of course, it has been turned on its head, but compared to most countries, the individual states making up the United States still hold considerable autonomy and authority.

If multiple federal agencies, including the leading investigative federal agency, are corruptly infested, then really the only outside solution lies with the states. They could create a unified investigative task force, obtain security clearances through the White House, conduct in-depth, investigations using their own and Congressional subpoena powers and bring charges to the Department of Justice to decide if indictments were warranted. There could potentially be dozens of states with the political gumption to undertake this.

This is way outside the box. But probably not unconstitutional. We are in uncharted territory and the house needs to be cleaned. It might be just the solution needed.

But regardless of the direction taken, the American people can no longer stand to the side and watch the country be undone by a mischievous, nefarious deep state working against the nation’s interests. Such corruption cannot stand.

The Deep State’s Path to Destroying America From The Inside

One great and amazing constant in American history is that we have a peaceful handover of power every four to eight years.

King George was shocked by it, as was Napoleon later. We follow the Constitution, the laws, and our national heritage even if the losing side seriously does not like or agree with the new president; even if the campaign was brutal and close. Our willingness to always rally around the new president has even been named the “honeymoon” period when all Americans united behind him. It runs the gambit from average Americans to top federal officials.

We on the political right did that with President Obama. Twice. And it was painful. We believed him to be a hugely damaging leader seeking to “fundamentally change” our nation for the worse — something he accomplished to the national detriment. We are far worse off, as is the world, for the presidency of Barack Obama. But we did not seek his removal or actively undermine him at the federal agency level — although those are dominated by Democrats.

(Don’t anyone start on me with the Trump Russian collusion garbage. Obama was caught on a live mic telling Russia in front of the world what he thought he was saying in secret: “Tell Vladimir (Putin) I’ll have more flexibility after the election,” he said to Putin’s right hand man. Obama then allowed Russia to run wild in eastern Europe, overrunning and occupying Crimea, taking eastern Ukraine, ensconcing himself in Syria and gaining a major ownership stake in our uranium, all while he dismantled our missile defenses that Russia hated. You want to talk about Russian collusion, that is worth investigating.)

But the long and great American tradition of accepting the new president by the losing side is being destroyed by the political left in this country. This is not just the radical left like Antifa or college campuses. This is Democratic Congressional leadership and virtually every element of the media that is supposed to be an objective watchdog but is clearly acting as an arm of the Democratic Party. This includes former President Obama’s team apparently seeding the federal government with confidential information that was “leaked” over months to damage the new President — a portion of the Deep State of bureaucrats within the federal monolith that act on their own agendas outside the will of the American people.

The left is charting a new course in response to a duly elected president — not just the normal congressional obstruction from the opposition party, but challenging virtually everything in court, and illegally and sometimes violently trying to undermine the new president.

This is unprecedented outside the election of Abraham Lincoln. However, what is new is a massive government that is chock full of political activist enemies known as the Deep State. More is being found out about this disease all the time.


Another Deep State element revealed

The latest threat to be revealed to our cherished tradition of a peaceful transfer of power comes through the Consumer Protection Financial Bureau, yet another expansion of the federal government under Obama that should never have existed in the first place and is probably unconstitutional. Trump installed his Office of Management and Budget Director Mick Mulvaney as the interim director after the Obama director resigned. Naturally, true to their destructive course, Democrats challenged this simple act in the courts but were slapped down by a judge.

Recently, the New York Times buried a small item in a longer story on the CFPB story but Hotair reporters picked it up. It seems there is a cohort of employees within that rogue agency that is actively fighting against Mulvaney and Trump and bypassing the approved channels for communicating to keep their plotting secret. (These are federal employees within the executive branch and their ultimate boss is the President.)

They call themselves “Dumbledore’s Army,” because apparently they are juveniles whose reading level is Harry Potter novels — or maybe just the movies. Here’s the takeaway from Hotair.

“‘Dumbledore’s Army’ is attempting the exact same thing (as their resigned boss attempted) — the creation of unelected bureaucrats as their own authority, without any accountability to voters or the people they elect to govern. It’s a palace revolt by self-important functionaries…”

Indeed. Hopefully Trump will clean house. Ruthlessly. It would be even better to shut down the CFPB. But the problem is this disease is rampant throughout the federal government. We’ve seen the State Department actively working against Trump (as it did President Bush) along with multiple other federal agencies that are part of the executive branch.

One wonders at what level this palace revolt is going on in the FBI — and truly, what can be done about it if the top investigative agency in the nation is compromised — which is another post.

Elections have consequences, as Obama arrogantly lectured Americans, putting everyone on notice he would do as he pleased. OK. But apparently that is no longer true when a Republican is elected that liberals don’t like. Remember #notmypresident? And now #resist. These are not in the great American tradition. They are antithetical to it. And it is deeply embedded in federal government agencies as we continually see.

The Deep State is setting the stage for an ugly future. Because it is quite unlikely that many Republicans and certainly Trump supporters will quietly accept the next Democratic president. As is the human nature of these things, it may spiral even worse with each election. That is not a pretty picture.

Without a return to the American norm of accepting the results of presidential elections, and a peaceful, orderly handover of power, it’s hard to see how we sustain the nation long term.
